The course can also be set during the contract-drafting phase before a company is founded, but also during the contract review of an already active company, in order to avoid a later legal dispute. Our experience in dealing with arbitration, escalation and shoot-out clauses can prevent long-standing and costly disputes between shareholders. In the past, the optimization of articles of association as part of a smart dispute management mandate has contributed to an efficient and cost-optimized shareholder separation for many medium-sized companies. If, however, a (arbitration) court dispute arises, we provide our clients with specialists who have extensive forensic experience. We always develop cost and interest-oriented litigation tactics with the aim of fully asserting the client’s position. Under no circumstances does our work end with the enforcement of the claim.
